Terms of Service

These terms of service ("Terms") and the end-user license agreement ("EULA") govern access to and use of the UGC Pocket application and service. By creating an account or using the service, you accept all of the clauses below without reservation.

1. Purpose of the service

UGC Pocket is a marketplace connecting brands ("organization" accounts) that order user-generated content (UGC) video campaigns with creators who are paid to produce and, where applicable, publish that content. UGC Pocket provides the technical platform for matchmaking, campaign management and deliverable tracking; UGC Pocket is not the author of the content created by creators.

2. Access, account and minimum age

Access to the service is strictly reserved for persons aged 18 or over. By creating an account, you declare that you are at least 18 years old and have the legal capacity to enter into a contract.
You are responsible for the accuracy of your account information and for keeping your credentials confidential.
"Organization" accounts can generate API keys (ugcp_live_…) allowing an automated agent to prepare campaigns as drafts. A campaign ordered by an agent must always be confirmed and funded by a human in the app before any go-live.

3. Code of conduct and content

No objectionable content and no abusive behavior is tolerated.

The following are notably prohibited: content that is hateful, violent, sexually explicit, defamatory, deceptive or that infringes the rights of third parties (intellectual property, privacy, image), as well as harassment, impersonation, spam and any attempted payment fraud. You warrant that you hold all the rights necessary for the content you publish or deliver.

4. Moderation and reporting (SLA)

Any user can report content, a profile or a behavior via the built-in reporting feature or by email to support@ugcpocket.com.
Moderation commitment: a 24-hour processing time applies to reports concerning manifestly illegal content or abusive behavior.
UGC Pocket may remove content, suspend or terminate an account in the event of a breach of these Terms.

5. Moderation of illegal content (DSA)

In accordance with Regulation (EU) 2022/2065 on digital services ("DSA"), UGC Pocket provides a notice-and-action mechanism for reporting illegal content, processes these notifications diligently, and informs the user concerned of the measures taken as well as of the remedies available. 6. Application license (EULA)

UGC Pocket grants you a personal, non-exclusive, non-transferable and revocable license to use the application, for purposes consistent with these Terms. You may not copy, decompile, disassemble, modify, rent, resell or circumvent the technical protection measures of the application, except within the limits of the mandatory rights granted by law. The application is provided "as is"; to the extent permitted by applicable law, UGC Pocket excludes all implied warranties. This license terminates automatically in the event of a breach.

7. Payments and creator compensation

No online payment is processed by the platform. Creator compensation is settled by manual bank transfers.

Campaign amounts are expressed in euros (budget per creator, expressed in cents on the technical side). The minimum budget per creator is €50.
Once a deliverable is approved and the payment trigger is met, the compensation due to the creator is paid by bank transfer within 5 business days.
The brand undertakes to fund the campaign it confirms in the app.

8. Liability and termination

UGC Pocket cannot be held liable for content produced by creators or for the commercial relationships between brands and creators beyond its role as a technical intermediary. You can terminate your account at any time from the app (see the Support page). UGC Pocket may suspend or terminate access in the event of a breach of these Terms.

9. Governing law

These Terms are governed by French law. Failing an amicable resolution, the French courts have jurisdiction, subject to the mandatory provisions applicable to consumers.
